Description

Sentencing Law in New Zealand provides an in-depth yet accessible discussion of the theoretical and legal foundations of sentencing law and procedure. 

 

This new edition follows the practical framework of the first edition, published in 2021.  It opens with chapters which provide context for both the current law and a solid introduction to sentencing theory, which is followed by a detailed account of the sentencing purposes and principles laid down in the Sentencing Act 2002 and of the variety of sentencing options which are available to judges. These foundation chapters are followed by topic-based chapters on issues which may arise prior to a finding of guilt, and chapters on particular challenges to the courts such as sentencing of offenders with FASD or traumatic brain injuries.  The final chapters are on parole and post-sentencing issues.

 

The second edition incorporates developments in common law, policy, trends, and legislation, such as amendments brought in by the Sentencing (Reform) Amendment Act 2025, modified three-strikes scheme, Gangs Act 2024; and the ongoing integration and recognition of Tikanga Māori in sentencing processes.
